
Relief has finally come the way of the children of late Ajayi Bello after five years of legal battle over the ownership of a vast expanse of land measuring approximately 1.310 hectares situate at Oke-Odo, along the Lagos Abeokuta Expressway in Lagos State, as sheriffs and court bailiffs supervised the possession of the land by the owner.
Justice Y. G. Oshoala of a Lagos High Court granted an Order of Possession in favour of the claimants and restrained all the defendants jointly and severally from further trespassing on the land delineated on Survey Plan No WAT/ LA/2894A dated June 6, 1985 drawn by W. A.T Adeniji, a licensed surveyor.
The claimants, Olusola Odetola, Sherifat Soyoye (nee Bello), Kehinde Shehu (Nee Bello), had in suit number ID/8649LMW/2019, prayed the court for a declaration that the forceful entry by the defendants into their land is unlawful.
While, the defendants in the suit are David Famuyiwa; Akinwumi Odeyemi; Olugbenga Sogbamu, for themselves and on behalf of Agbado/Oke-Odo Local Government Development Area (LCDA of Lagos State) and Alimosho Local Government Council.
The claimants being the beneficiaries of the property of their late father, Ajayi Bello, who died intestate many years ago, under Yoruba Native Law and Custom in their amended statement of claim, stated that the defendants trespassed into the disputed land.
The claimant tendered before the court Survey Plan No. WAT/LA/28944 dated June 5, 1985, and layout plan which were admitted as exhibits, and also led in evidence that they wrote a petition complaining of the trespass to the Executive Chairman, Agbado/ Oke-Odo LCDA and to the Chairman, Lagos State Special Task Force.
However, the defendants denied in their pleading that they trespassed on the claimants land, contending that the claimants should have contacted the police over the displaced marketers who invaded their land.
